Terms of Service

1. Agreement to Terms
By accessing or using the services of 7 Color Box LLP ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations of India. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Services Offered
7 Color Box LLP provides the following services:
- Marketing & Branding
- Content Production
- Influencer Marketing
- Web & App Development
- Sales & Leads Management
- Packaging & Printing
- Public Relations
Specific terms, deliverables, timelines, and pricing for each service will be outlined in individual project agreements or statements of work.
3. Payment Terms
3.1 Payment Schedule
- Payment terms will be specified in the project agreement
- Typically, an advance payment of 50% is required to commence work
- The remaining balance is due upon project completion or as per milestone payments
- All payments must be made in Indian Rupees (INR)
3.2 Payment Methods
We accept payments via bank transfer (NEFT/RTGS/IMPS), UPI, credit/debit cards, and other digital payment methods as communicated.
3.3 Late Payments
Late payments may incur an interest charge of 2% per month or as permitted under Indian law. We reserve the right to suspend services until outstanding payments are received.
3.4 Taxes
All fees are exclusive of applicable taxes including GST. Taxes will be added to invoices as required by Indian tax laws.
4. NO REFUND POLICY
ALL PAYMENTS MADE TO 7 COLOR BOX LLP ARE FINAL AND NON-REFUNDABLE.
Once payment has been processed, no refunds will be issued under any circumstances, including but not limited to:
- Change of mind or project cancellation by the client
- Dissatisfaction with services (subject to revision policy)
- Delays caused by the client
- Force majeure events
- Technical difficulties or third-party service disruptions
By making a payment, you acknowledge and agree to this no-refund policy. Ensure you fully understand the scope of work and deliverables before making any payment.
5. Revisions and Changes
- Each project includes a specified number of revision rounds as outlined in the agreement
- Additional revisions beyond the agreed scope may incur extra charges
- Revision requests must be submitted within 14 days of deliverable submission
- Major scope changes will require a new agreement and additional payment
6. Client Responsibilities
Clients are responsible for:
- Providing accurate information, content, and materials required for the project
- Timely feedback and approvals to prevent project delays
- Ensuring they have the right to use any materials provided to us
- Maintaining confidentiality of any login credentials or sensitive information
- Making timely payments as per the agreed schedule
Delays caused by the client may extend project timelines without penalty to the Company.
7. Intellectual Property Rights
7.1 Client Ownership
Upon full payment, the client receives ownership of the final deliverables specifically created for their project, excluding any pre-existing materials, templates, or intellectual property owned by the Company.
7.2 Company Rights
- We retain the right to showcase completed projects in our portfolio
- Pre-existing tools, frameworks, and methodologies remain our property
- We may reuse general concepts, techniques, and know-how gained from projects
7.3 Third-Party Assets
Stock photos, fonts, plugins, or other third-party assets may require separate licensing. Clients are responsible for obtaining necessary licenses unless otherwise agreed.
8. Confidentiality
Both parties agree to keep confidential information disclosed during the project confidential and not to disclose it to third parties without prior written consent, except as required by law.
9. Limitation of Liability
To the maximum extent permitted by Indian law:
- Our liability is limited to the total amount paid by the client for the specific service
- We are not liable for indirect, incidental, or consequential damages
- We do not guarantee specific business results or outcomes
- We are not responsible for losses due to third-party service failures
- Website/application hosting, domain registration, and third-party integrations are the client's responsibility unless explicitly agreed otherwise
10. Warranties and Disclaimers
10.1 Our Warranties
We warrant that services will be performed with reasonable skill and care in accordance with industry standards.
10.2 Disclaimers
Except as expressly stated, all services are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Termination
11.1 By Client
Clients may terminate the agreement with 15 days written notice. All payments made up to the termination date are non-refundable, and the client will receive deliverables completed up to that point.
11.2 By Company
We may terminate services immediately if the client breaches these terms, fails to make payments, or engages in abusive or unethical conduct.
12. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, fuel, energy, labor, or materials.
13. Indemnification
Client agrees to indemnify and hold harmless 7 Color Box LLP from any claims, damages, liabilities, and expenses (including legal fees) arising from:
- Client's breach of these terms
- Content or materials provided by the client
- Client's use of deliverables in violation of applicable laws
- Infringement of third-party rights by client-provided materials
14. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh, India.
15. Dispute Resolution
In the event of any dispute:
- Parties shall first attempt to resolve the matter through good faith negotiation
- If unresolved within 30 days, the dispute may be referred to mediation
- If mediation fails, the dispute shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996
- The arbitration shall be conducted in Noida, Uttar Pradesh, in English language
16. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be notified via email or website notice. Continued use of services after changes constitutes acceptance of the modified terms.
17. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms of Service, together with any project agreements and statements of work, constitute the entire agreement between you and 7 Color Box LLP regarding the use of our services.
